Terms of Use 

1. Acceptance of Terms

 

Welcome to VoteMate ("we," "our," "us"). We are a 501(c)(3) nonpartisan, nonprofit. By accessing or using our websites (votemateus.org and votemate.io) and services (collectively, the "Services"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our Services. 

 

2. Eligibility 

You may not use our Services if: 

  • You are under 16 years of age, in which case you must not create an Account, use any of our Services, or submit personal information in the Services or to VoteMate.  

  • You have previously been banned from using any VoteMate app or using any VoteMate Service, unless VoteMate has reversed that ban, in its sole discretion. 

If you are under the age of 18, or under the age of majority where you are located, you represent that your legal guardian has reviewed and agreed to these Terms. 

3. Use of Services 

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are prohibited from: 

  • Tampering with or manipulating the content of our website. 

  • Using the Services in any manner that could disable, overburden, or impair the site or interfere with any other party's use. 

  • Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the Services. 

  • Attempting to reverse engineer, decompile, or discover the source code of our Services. 

  • Using automated systems or software to extract data from our Services without prior authorization. 

  • The Services are intended for use only within the United States. You may not use the Services in violation of U.S. export control or sanctions laws. 

 

4. VoteMate Trademark 

The VoteMate name is a legally protected trademark of VoteMate. VoteMate reserves all rights in such marks. You are not authorized to use the trademarks, seals, or logos of VoteMate without prior written consent. 

5. Patent Pending Status 

VoteMate's system and technology are patent pending. VoteMate reserves all rights to its proprietary technology, features, and processes. Any unauthorized use, reproduction, or distribution of VoteMate’s intellectual property is strictly prohibited. 

6. Intellectual Property Rights 

All content, features, and functionality on our website, including text, graphics, logos, and software, are the exclusive property of VoteMate or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any material from our Services without prior written consent. 

7. Data Privacy & Security

You are solely responsible for maintaining the confidentiality of any account credentials you use to access the Platform. VoteMate implements reasonable administrative, technical, and physical safeguards designed to protect information under our control. However, no system can be guaranteed completely secure, and we do not warrant that the Platform or any third-party service providers will be free from unauthorized access, loss, misuse, or disclosure. Use of third-party services is at your own risk, and VoteMate disclaims any liability for acts, omissions, or security failures of those third parties. 

Our Privacy Policy provides information on our use of data. 

8. Accessibility & Compliance 

VoteMate strives to comply with applicable accessibility laws and ensure that our website is usable for individuals with disabilities. If you experience any accessibility issues while using our Services, please contact us for assistance. 

9. Donations and Third-Party Services

 

Donations to VoteMate are tax-deductible only to the extent allowed by law.  

If you provide a donation to VoteMate, we facilitate donations through an integration with Zeffy, a third-party service. VoteMate does not store or process any payment information directly. Users should refer to Zeffy's Privacy Policy for details on how their payment information is handled. 

10. User Contributions

 

If you submit any content or materials to our Services, you grant VoteMate a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with providing the Services. 

11. Disclaimer of Warranties

VoteMate provides the Services on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the Services, nor do we warrant that the Services will be free from defects, security risks, or other harmful elements such as malware or viruses. 

To the fullest extent permitted by law, VoteMate disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will always be available, secure, or free of inaccuracies, and you use such services at your own risk. 

12. Limitation of Liability and Release 

To the fullest extent permitted by law, VoteMate shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use our Services. This includes but is not limited to errors, omissions, failed internet connections, unauthorized use, lost data, breaches of security, transmission delays, and any damages resulting from harmful components such as viruses or malware. 

VoteMate’s aggregate liability to you and all third parties for any damages, losses, or causes of action shall not exceed $100 USD. Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or for violations of applicable consumer protection, privacy, or security laws where such limitations are not permitted. In all other cases, our aggregate liability will not exceed the greater of (i) $100 or (ii) the amounts you paid to VoteMate for the Services in the 12 months before the event giving rise to the claim. 

If you have a dispute with VoteMate, you release VoteMate (and its members, officers, directors, employees, and agents) from all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with such dispute. If you are a California resident, you expressly waive your rights under California Civil Code section 1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." 

13. Indemnification 

You agree to defend, indemnify, and hold harmless VoteMate, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Services. 

14. Termination 

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. 

15. Modifications to Services 

VoteMate reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that VoteMate shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services. 

16. Third-Party Content; No Legal or Official Election Advice

Our Services may include content provided by third parties. All statements and opinions expressed in such content are solely the responsibility of the person or entity providing the content. We are not responsible, or liable to you or any third party, for the content or accuracy of any third-party materials. 

You acknowledge that VoteMate provides nonpartisan, educational information only and does not endorse or oppose any candidate or political party. You remain solely responsible for verifying your eligibility to vote, registering to vote, and complying with all applicable election laws. VoteMate disclaims any responsibility for errors or omissions in election-related content and encourages you to confirm all deadlines and requirements with your official election office.

17. Governing Law 

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. 

18. Dispute Resolution 

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. 

Such dispute, claim, or controversy will be resolved on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. To the fullest extent permitted by law, class arbitrations, class actions, private attorney general actions, and consolidation with other proceedings are not allowed. 

19. Severability 

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. 

20. Entire Agreement 

These Terms constitute the entire agreement between you and VoteMate regarding your use of our Services, superseding any prior agreements. 

21. Changes to Terms 

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use our Services after any changes become effective, you agree to be bound by the revised Terms.
